Your Mid-term project requires you to analyze, interpret, and discuss the following legal issues that Covid-19 has and continues to present us with. Your paper will be titled Individual Freedom vs. Well Being of the Greater Public. This will be a combination of your opinion and factual, legal issues; it examines moral/ethical and legal issues. Your opinion is important, but like all critical thinking exercises, needs to be based on reason and facts. You are to interpret this issue with a wide-angle lens. Your opinions in this paper are not to win a popularity contest or to intentionally align your thoughts with friends, peers, professors, politics, etc. This is to become generally more knowledgeable on the topic, to better inform yourselves about history and the law, and perhaps to reinforce with facts and sound reason your pre-existing thoughts. Analyze all sides, understand and attempt to appreciate the positions of all sides, review legal history and the founding facets of our republic protecting individual freedoms as well as the government’s role in the preservation of life of its people, and review current laws or potential laws.
This is a paper, not a list of subjects. I am simply presenting you with a list of topics below that need to be covered in your assignment. An abundance of research and sources is expected. This will be discussed in class the week they are due, so be prepared to be called upon or voluntarily share your thoughts. This assignment cannot be submitted late for less credit. The paper should be 5 to 8 pages, double spaced, font size 12. More or less will likely result in a loss of credit.
1) Start your paper by comparing and contrasting what 1) Individual Liberty means to you and what 2) The Well Being of the Greater Public mean to you. Use your opinions and feelings considering what our country was founded upon as well as any role the government plays in protecting its people. 2) Three parts – Without doing any research and based on only your knowledge to this point in your assignment, do you believe (1) mandatory vaccines and (2) mandatory quarantines of infected persons are legal? Why or why not? (3) Is there a difference between private entities makes these mandatory vs. a public/government entity making these mandatory? (This is an opinion question, do not cheat yourself of the learning process by actually researching any legal precedent you know little about, yet).
3) Now, research the topic of whether mandatory vaccines and mandatory quarantines are legal in the United States. You can use other countries for reference, but your primary goal is researching OUR laws. Show what you’ve learned to include any laws on the books and any Court cases siding one way or the other. There is a significant case on this topic that was heard before the Supreme Court a long time ago, find it. What do the Court cases or laws you found say?
4) This is two parts as we combine our opinions with legal precedent: 1) Do you believe mandatory vaccine laws should exist, and if so, in what way? If not, why not? 2) Regardless of whether you support mandatory vaccines or not, do you think it is LEGAL to enact and enforce such laws?
5) After having done research, has your opinion on the subject changed? If it did, explain how and if it did not, explain why your position remains the same.
